November 8, 2013 - "Conventional wisdom says this Congress won't enact a policy that requires companies to pay for the carbon emissions they produce, and that's probably right. The politics are just too hard in 2013. But the underlying logic of that approach is something that's hard to argue with, regardless of where you fall on the political spectrum....

"But what about libertarians who strongly oppose high taxes and onerous regulations? You might assume that opposing a carbon pollution tax or regulations to limit emissions would be their natural position. But a closer look suggests it may not be that simple....

"At its core, I think Libertarianism is the belief that individuals and companies should be free to do as they please, as long as their actions don't significantly harm others. For instance, libertarians support rules against murder, arson and theft -- because while those laws might be government restrictions on the complete freedom of the criminal, they are necessary to prevent great harm to other individuals....

"In business, I would think the principle is the same.... [W]hat if [a] company is causing harm to an unwilling party, or shifting costs to society? Then they are imposing on the freedom and well-being of others....

"Of course, libertarian solutions to climate change may be far different from the ideas suggested by progressive environmentalists. They might prefer giving individuals and companies the right to sue polluters for the cost imposed by their actions. Perhaps they'd [accept] a tax that accounted for the costs to society, but only in exchange for an equal reduction in taxes on income or property."

"The briefing notes, stamped 'Top Secret,' show the U.S. turned its Ottawa embassy into a security command post during a six-day spying operation by the National Security Agency [NSA] while U.S. President Barack Obama and 25 other foreign heads of government were on Canadian soil in June of 2010....

"An NSA briefing note describes the American agency's operational plans at the Toronto summit meeting and notes they were 'closely co-ordinated with the Canadian partner.'

"The NSA and its Canadian partner, the Communications Security Establishment Canada, gather foreign intelligence for their respective governments by covertly intercepting phone calls and hacking into computer systems around the world.

"The secret documents do not reveal the precise targets of so much espionage by the NSA — and possibly its Canadian partner — during the Toronto summit."

November 27, 2013 - "A controversial new tax law that Kentucky Sen. Rand Paul is attempting to repeal is driving hundreds of well-heeled Americans living abroad to renounce their U.S. citizenship.

"The Foreign Account Tax Compliant Act, passed in 2010, requires financial institutions overseas to provide the Internal Revenue Service with annual reports on their U.S. account holders.

"The law, which is aimed at expatriates holding $50,000 or more in their banks, was enacted to prevent Americans from evading taxes. But Americans with dual citizenship are up in arms, and are dumping their U.S. passports at a record rate, McClatchy Newspapers reports. Singer Tina Turner, Facebook co-founder Eduardo Saverin, and Democratic fundraiser Denise Rich all have renounced their citizenship in the past two years.

"The number of people who have relinquished their citizenship has soared from 742 in 2009 to more than 1,854 this year, according to the State Department.

"'[The law] is a textbook example of a bad law that doesn’t achieve its stated purpose but does manage to unleash a host of unanticipated, destructive consequences,' said Paul as he introduced a bill this year to repeal it. 'Tax evasion is a problem that should be addressed, but not in an egregious way.'"

November 23, 2013 - "My father, age 86, is on the final approach to the long dirt nap (to use his own phrase). His mind is 98% gone, and all he has left is hours or possibly months of hideous unpleasantness in a hospital bed. I'll spare you the details, but it's as close to a living Hell as you can get.

"If my dad were a cat, we would have put him to sleep long ago. And not once would we have looked back and thought too soon.

"Because it's not too soon. It's far too late. His smallish estate pays about $8,000 per month to keep him in this state of perpetual suffering. Rarely has money been so poorly spent.

"I'd like to proactively end his suffering and let him go out with some dignity. But my government says I can't make that decision. Neither can his doctors. So, for all practical purposes, the government is torturing my father until he dies.

"I'm a patriotic guy by nature. I love my country. But the government? Well, we just broke up."

"Bruce Majors [who] has filed to be the Mayor of the District of Columbia ran for Congress in 2012 earning 16,500 votes which qualified the Libertarian Party for permanent ballot access. Often times, Libertarian Party candidates will need to spend financial and human resources in order to secure themselves a place on the ballot - something not needed by Republican or Democratic candidates. Majors has been a resident of the District of Columbia since 1980 and [is] a popular Realtor for the area.

"Sara Jane Panfil has filed to be a D.C. delegate to Congress and is a graduate of Columbia University. In his opinion piece Mr. Veit explains perfectly why Adrian, myself and many other Libertarians do not belong to the Republican Party. He and other leaders like him have been and still are willing to say anything to try to scare people into continuing to vote for the members of the Republican Party. "In this opinion piece he wrote:
'They are at it again. The Libertarian Party, after successfully electing a Democrat governor in Virginia as opposed to a Republican supported by the tea party, is making a run here in Florida that will guarantee the same result. It’s public record that a major financial backer for the Virginia Libertarian Party candidate was also a Democrat fundraiser for Obama’s last campaign. Curious??'
"This elected official in the Republican Party wrote something that is completely false. Exit polling proved that Sarvis, the Libertarian candidate for governor in Virginia, was supported by more people that identified themselves as liberal on Election Day than those that considered themselves conservative....

"He is also claiming that there had been a conspiracy perpetrated by the Democrat Party to have Sarvis in the race. This again was absolutely false.

 "As written about in this NPR article:
'But a few things are off here. The $150,000 that they cite went to an existing Libertarian PAC, not the candidate. A co-founder of the PAC says less than $20,000 found its way to Virginia, for both Sarvis and legislative candidates. And the mystery donor is more generous to Libertarians than to Democrats.

November 16, 2013 - "[I]n the recently-concluded governor’s race for Virginia ... a Democrat beat a Republican by a mere 1% of the vote.... But that wasn’t the only story: In the same election, Robert Sarvis, a little-known candidate with a campaign budget of just $200,000, won more than 6% of the vote. Never before has any Libertarian candidate for governor of Virgina - even Bill Redpath, National Director of the Libertarian Party at the time he ran - ever received as much as 1% of the vote. Until now, 6% for a Libertarian in that state was simply inconceivable.

"This is not the only ‘personal best’ that Libertarians have achieved recently. Last year, for instance, Gary Johnson received more than a million votes: the first time, in the Libertarian Party’s 40-year existence, that its presidential candidate has passed that benchmark. While that was still a small fraction of the vote (less than 1%), other Libertarians - such as Dan Cox, senatorial candidate in Montana - scored, like Sarvis, in the high single digits.

"Those signs of progress ... have led to attacks on the Libertarian Party, and even to advice/demands for it to disband. Sarvis’s best-ever showing has begun to prompt similar reactions."

This contest will decide who fills the congressional seat left vacant since October’s death of long-time Florida Republican Congressman Bill Young.

"Between the fundraiser and the LPF donation, Overby brought in over $12,000, comfortably above the required $10,440 filing fee needed for the Libertarian to be listed along with his Democratic and Republican opponents.

"The Overby Campaign organized the money bomb late last week, after the petition-drive effort to get Libertarian Party (LP) Candidate Lucas Overby’s name listed alongside the Democrat and Republican fell short by a heartbreaking 19 signatures.

"Overby for Congress campaign workers gathered over 1,600 petitions, and submitted in excess of 1,300. However, the Florida Division of Elections (DOE) Office in Tallahassee only approved 1,153; Overby needed 1,172 to earn ballot access."

NM man stopped for traffic violation, anal probed for 14 hours

November 5, 2013 - "What began as a routine traffic stop turned into a 14-hour probe of a New Mexico man’s anal cavity and intestines by police and doctors.

"David Eckert’s ordeal began innocently enough with a shopping trip to Wal-Mart in Deming, N.M. on Jan. 2, 2013.

"According to police, Eckert rolled through a stop sign while driving out of the store’s parking lot. He was promptly pulled over and asked to step out of his vehicle....

"'They say when he stepped out of his car, he was standing in a manner that looked as if he was clenching his buttocks,' Shannon Kennedy, Eckert’s attorney, told KOB-TV....  So, they obtained a warrant to do an anal-cavity search.

"For the next 14 hours, Eckert was subjected to X-rays, cavity searches, several enemas and a colonoscopy at the hands of police and hospital employees ... despite his protestations....

"The medical center billed Eckert for all the medical procedures and has threatened to pursue him if he doesn’t pay."

The story's protagonist, Zoey Trask, is torn between her parents' competing worldviews: her dad's libertarianism and her mom's spirituality. (Believing in spirits, Zoey's dad notes, is worse than stupid — it's irrational). While the novel is billed as a thriller, Greenwood's funny, psychologically astute characters make the fantastical story line seem just outside the bounds of normal. An excerpt:
Your dad probably read you books like The Giving Tree when you were a kid. My dad did read me The Giving Tree once, calling it "evil" in that it "promotes the immoral destruction of the self." (I was four.) He preferred Atlas Shrugged, which is basically about how rich people shouldn't pay taxes. He has explained to me a lot over the course of my seventeen years that taxes are "slavery." People are only "free when they act as they want to act." Perfect for toddlers — is my sarcasm coming through? — Atlas Shrugged is also the novelized explanation of the writer Ayn Rand's "objectivist" philosophy, of "rational self-interest," in other words: extreme selfishness....
"I've known Greenwood, and even worked with her briefly at The Huffington Post. A journalist by day, she adores animals and lives with her husband, Ray, in Old Town Alexandria, Va., where Save the Enemy is set. I interviewed her Monday about her new novel, which was published today by SoHo press."

November 8, 2013 - "The Libertarian Party of Ohio has filed a federal lawsuit this afternoon arguing that the law signed by Gov. John Kasich on Wednesday setting requirements for minor party recognition is unconstitutional.

"Mark Brown, the lead attorney for the lawsuit, said the timing of the law’s enactment – it takes effect Feb. 5, the day of the 2014 candidate filing deadline – and the law blocking minor parties from holding a primary election next year will be the key arguments.

"The lawsuit’s timing argument cites federal 1st and 14th Amendment violations, Brown said, It also makes a state constitutional argument under Article 5, Section 7, which says that 'all nominations for elective state, district, county and municipal offices shall be made at direct primary elections or by petition as provided by law.'

"'Basically what Ohio has done is retroactively taken ballot access away from the (Libertarian Party) and its candidates,' Brown said. 'You can pass valid retroactive legislation, but you have to be careful about it, and especially in the First Amendment or the voting context, it’s strongly frowned upon by the federal courts.'"

October 28, 2013 - "The recent fiscal crisis has opened a major rift between the tea party wing of the Republican Party and business groups that traditionally have backed Republicans, with many business leaders now vowing to get involved more in GOP primaries to try to counter insurgent candidates.

"Tea party leaders are defiant, saying they will not change course despite criticism from the U.S. Chamber of Commerce, Business Roundtable and other top business groups.

"But business leaders argue that the scorched-earth tactics used by tea party Republicans during the 16-day shutdown and debate over raising the federal government’s borrowing limit marked the fourth time since the GOP took control of the House in 2011 that tea party adherents precipitated a governmental crisis that zapped consumer and business confidence, raised uncertainty and exerted a major drag on economic growth.

"Shawn Felty, chairman of the Libertarian Party of Schuylkill County, was elected to the Cressona borough council....

In an interview ... Felty said that he was the only Libertarian on the ballot in the whole county, and he doesn't know when the last Libertarian was elected to office in Schuylkill County.

"'We didn't even have an organized Libertarian party in Schuylkill County for the last several years, maybe for 10 years,' he said. 'We just really got things going this year. There are registered Libertarians in the county, I think it's, like, 400, but last year there was only, like, one paid member. And now we have about 15'....

"[I]n a letter to the editor in June, George H. Bauscher, vice chairman of the Libertarian Party of Schuylkill County, said that Libertarians believe in, and pursue, personal freedom while maintaining personal responsibility.

"He also wrote that Libertarians strongly oppose any government interfering in people's personal, family and business decisions, and all Americans should be free to live their lives and pursue their interests as they see fit as long as they do no harm to another."

Sarvis was the Libertarian candidate in the election who pulled in just over 6.5% of the vote. This wasn’t just a landmark achievement for a third party candidate in Virginia but in the entire American South.... As Richard Winger of Ballot Access News told the Daily Beast, no third party gubernatorial candidate in the South has performed this well in over forty years....

"Sarvis received attention throughout the campaign, not just on election night. He polled above 10% through much of the fall and even received a newspaper endorsement.. Although he wasn’t included in any of the debates, he ran television ads and was considered a possible spoiler throughout the campaign. Republican Ken Cuccinelli was so worried about Sarvis that he focused his strategy in the final days of the campaign on appealing to wavering libertarians. In fact, Cuccinelli’s final rally was headlined by Ron Paul in an attempt to appeal to these voters....

"The question, which was heavily debated before, during and after the election was where Sarvis pulled his supporters from and whether his campaign drew more votes away from Democratic governor-elect Terry McAuliffe or from the socially conservative Republican, Cuccinelli. Based on the crosstabs of a CNN exit poll, it appears that statewide, Sarvis voters leaned toward McAuliffe as their second choice. However there was a lot of regional variation."

October 29, 2013 - "The American Values Survey is based on responses gathered in late September and early October from a representative group of about 2,300 adults. The researchers used answers to questions about national security, economics, and 'personal liberty' to create a 'Libertarian Orientation Scale.' By such measures, 7 percent of Americans are 'consistent libertarians' and another 15 percent 'lean libertarian,' meaning they oppose increased government spending on things such as military operations and domestic surveillance, raising the minimum wage, and environmental regulations.

"Such fiscal conservativism is matched by social liberalism, with libertarians in favor of legalizing marijuana, protecting abortion rights, allowing doctors to prescribe life-ending drugs, and keeping the Internet unregulated. Libertarians are much more likely than most Americans to be male, white, and under 50 years old. They are also far less likely than most Americans to be religious and to think that religion has a place in politics. This puts them at odds with 'other key Republican base groups' such as the Tea Party movement....

As befits people who put a high value on individualism, libertarians don’t fit easily into existing political categories even as they are far more likely to pay close attention to politics than the average American (56 percent of libertarians versus just 38 percent) and to always vote in primary elections.... "That means that the 22 percent of Americans who are consistent libertarians or lean libertarian are fully capable of throwing any election in their direction. That makes them the true wild cards of American politics."

Adam Kokesh changes not guilty plea to guilty

November 6, 2013 - "During an unscheduled hearing today, Libertarian and second amendment activist Adam Kokesh made a surprise plea of guilty on charges which stemmed from an incident on the fourth of July.

"On July 4, 2013, Kokesh videotaped himself loading a shotgun in Freedom Plaza inside Washington D.C., where carrying weapons on the street is illegal. He was arrested at his home in Herndon, Virginia on July 9 where additional weapons and a small amount of marijuana were also found.

"Online court records show that Kokesh accepted a plea today, just two weeks after he had pleaded not guilty to the same crimes, claiming that he was not guilty because he was exercising his constitutional rights.

"Kokesh had been in a D.C. jail since his July arrest but was released today after the plea and will be sentenced on January 17, 2014....

"Kokesh pled guilty to carrying a shotgun, possession of an unregistered firearm and unlawful possession of ammunition, and a separate charge of possession of marijuana.... At his sentencing in January, Kokesh could face more than six years in prison."

Portland, Maine, votes 2-1 to legalize marijuana use

November 5, 2013 - "Portland became the first city on the East Coast to legalize the recreational use of marijuana, on Tuesday.

"Portland voters approved a citizens referendum that legalized the recreational use of marijuana in city limits by a vote of 9,921 to 4,823, according to unofficial results released by the city clerk Tuesday night.

"The ordinance will allow adults, who are at least 21 years old, to possess up to 2.5 ounces of marijuana and requisite paraphernalia for recreational use. While people can use marijuana on their personal property, the language bars them from using it on any public infrastructure, including sidewalks, parks and roadways; but landlords and building owners can opt to bar smoking on their property....

"The Citizens for a Safer Portland Coalition, which was comprised of the Portland Green Independent Committee, the Marijuana Policy Project and the American Civil Liberties Union of Maine, led the legalization effort and gained the support of the Libertarian Party of Maine, the Marijuana Caregivers of Maine and a group of local legislators."

November 6, 2013 - "Libertarian Party candidate Robert Sarvis was never going to win the Virginia governor’s race. But he did better than most others in his party who’ve run for the top job around the country, the latest bit of encouraging news for advocates of the libertarian political philosophy, who have found increasing traction in recent elections.

"Sarvis finished a distant third on Tuesday, winning just 6.55 percent of the vote. Not enough to get his party future ballot access.... But stacked up against past Libertarian candidates for governor, Sarvis’s performance all of a sudden doesn’t look so bad.

"A University of Minnesota Smart Politics analysis found that his share of the vote was good enough for third all-time best among Libertarian candidates for governor and the best in a decade....

"The conventional wisdom is that it is a bad development for Republicans, the thinking being that Libertarian candidates are siphoning votes away from Republicans more than Democrats. But exit polls indicate Democrat Terry McAuliffe still would have won without Sarvis in the picture, pre-election polls suggested Sarvis wasn’t tipping the scales heavily in favor of either candidate."

October 31, 2013 - "Federal Judge William J. Haynes, Jr., chief judge of the Middle Tennessee district, ruled Thursday that the Shelby County Election Commission must list Jim Tomasik as a Libertarian Party candidate on the special election ballots for state House District 91 — not, as had previously been the case in preliminary listings, as an independent.

"The special election, which is scheduled for November 21, with early voting in effect from Friday, November 1, though Saturday, November 16, will pit Tomasik against Ramesh Akbari, who won the Democratic nomination for the seat in a special primary election on October 8. The election is to determine a successor to the late Lois DeBerry.

"In view of the closeness of the general election date, lawyers for Tomasik had sought an emergency injunction from Judge Haynes, who, after hearing arguments at a hearing Thursday, issued it from the bench."

October 29, 2013 - "Most American libertarians do not consider themselves part of the conservative Tea Party movement despite a public perception that the two political groups are linked, according to a national survey released on Tuesday.

"Libertarians, who generally support maximizing individual rights and minimizing the role of government, differ sharply with the Tea Party and religious conservatives on issues such as abortion and decriminalization of marijuana, according to the survey by the non-partisan Public Religion Research Institute.

"Sixty-one percent of libertarians do not identify themselves as part of the Tea Party, the survey showed. About 7 percent of the adult population is consistently libertarian and that includes 12 percent of those who describe themselves as Republicans.

"'There's largely agreement on economic issues - the gap is in how libertarians approach social issues,' said Robert P. Jones, CEO of PRRI, which conducts an annual 'American Values Survey' on political and social issues."

The candidate expanded on this during an oddly defensive interview with MSNBC’s Chuck Todd, in which he ... told Todd, he would be hesitant to cut taxes, unsure as to how he might 'reduce spending,' and open to indulging the largest piece of federal social policy since 1965 by expanding Virginia’s Medicaid program....

"Looking through his platform, one is left with the impression that what Sarvis really means to say is that he is a social liberal. "Cuccinelli has an A rating from the National Rifle Association; he has promised to cut the state’s income-tax rate by a stunning '15 percent for individuals and 33 percent for corporations'; he was against expanding the death penalty when the state GOP wished to make it part of their platform; he fought hard against the smoking ban; he has been a strong and active foe of Obamacare from the start; and he staunchly opposes the Medicaid expansion that further expands the power of the federal government. "Ken Cuccinelli sure hopes so.

"The Republican nominee for Virginia governor — who tried and failed to reinstate a ban on oral and anal sex in his home state — has been doggedly courting the party of individual liberty in a last-minute attempt to save his candidacy.

"Cuccinelli’s campaign has been lagging in the polls, with the latest Washington Post/Abt SRBI poll putting him at 39% among likely voters compared to 51% for Democrat Terry McAuliffe and 8% for Libertarian candidate Robert Sarvis. Those voters won’t propel Sarvis to the statehouse — but they could make a big difference for Cuccinelli, if only he can win them over. His bet: Virginia libertarians might not like his social conservatism, but it’s got to be preferable to McAuliffe’s big-government zeal for Obamacare.

"So he’s been touting the endorsement of free market hero Rep. Ron Paul, and at a campaign stop in Fairfax Monday, he was accompanied by Sen. Rand Paul (R-KY).... There were some confessed libertarians in the group. Jason Bowles of Fairfax, an earnest unshaven 28-year-old wearing a blazer, insisted that 'the real libertarian running is Ken Cuccinelli.' He thought Cuccinelli’s strong opposition to Obamacare made him the clear choice."
