US House votes to block civil forfeiture expansion

In Surprise Vote, House Passes Amendment to Restrict Asset Forfeiture - Zaid Jilani, The Intercept:

September 12, 2017 - "In a surprise move, the House of Representatives on Tuesday approved an amendment to the Make America Secure and Prosperous Appropriations Act that will roll back Attorney General Jeff Sessions’s expansion of asset forfeiture.

"Amendment No. 126 was sponsored by a bipartisan group of nine members, led by Rep. Justin Amash, R-Mich. He was joined by Democratic Reps. Ro Khanna of California; Washington state’s Pramila Jayapal, ... and Hawaii’s Tulsi Gabbard.

"Civil asset forfeiture is a practice in which law enforcement can take assets from a person who is suspected of a crime, even without a charge or conviction. Sessions revived the Justice Department’s Equitable Sharing Program, which allowed state and local police agencies to take assets and then give them to the federal government — which would in turn give a chunk back to local police. This served as a way for these local agencies to skirt past state laws designed to limit asset forfeiture....

"Amash, the prime mover of the amendment, spoke forcefully in favor of the Obama-era rules.... 'Unfortunately these restrictions were revoked in June of this year. My amendment would restore them by prohibiting the use of funds to do adoptive forfeitures that were banned under the 2015 rules,' he explained.

"Virginia Democratic Rep. Don Beyer reached across the aisle to voice support for Amash’s effort. 'Civil asset forfeiture without limits presents one of the strongest threats to our civil, property, and constitutional rights,' he said on the floor. 'It creates a perverse incentive to seek profits over justice.'

"The amendment passed with a voice vote, meaning it had overwhelming support.

"Republican Reps. Mark Sanford of South Carolina, Raúl Labrador of Idaho, and Dana Rohrabacher of California joined in the effort, along with Democrat Earl Blumenauer of Oregon."

Congressional Cannabis Caucus formed

Just how mainstream is marijuana? There’s now a “Congressional Cannabis Caucus.” - The Washington Post - Christopher Ingraham:

February 17, 2017 - "This week, a bipartisan group of U.S. representatives formed the first-ever "Congressional Cannabis Caucus" to work on legislation related to marijuana legalization and regulation.

"Democrats Earl Blumenauer of Oregon and Jared Polis of Colorado teamed up with Republicans Dana Rohrabacher of California and Don Young of Alaska to form the caucus. Not coincidentally, all four representatives hail from states where recreational marijuana use is legal.

"'The federal government’s decades-long approach to marijuana is a colossal, cruel joke, and most Americans know it,' Rohrabacher said in a news release announcing the formation of the group Thursday. 'Not only have incalculable amounts of taxpayers’ dollars been wasted, but countless lives have been unnecessarily disrupted and even ruined by misguided law enforcement'....

"'Because of the conflicts between Federal and State law, marijuana-related issues are no longer theoretical — they are real, and they are affecting real people in Alaska and across the country,' Young said in a written statement. 'I look forward to working with the Congressional Cannabis Caucus to educate my colleagues in the House on the issues we are facing in Alaska, and hopefully to also develop solutions to these problems.'

"Earlier this month, Rohrabacher introduced a measure called the Respect State Marijuana Laws Act of 2017, which would protect people from marijuana-related prosecutions under the Controlled Substances Act, provided that they were acting in compliance with state laws. The bill has drawn bipartisan co-sponsorship."

July 19, 2012 - "Ron Paul is right when he says that the federal War on Drugs has been an abysmal failure. William F. Buckley and National Review were right when they said the same thing in 1996. Milton Friedman was right when he said the same thing in 1972 when President Nixon created the federal War on Drugs....

"Reports The Hill today: A bipartisan group of House members has proposed legislation that would make it easier for people to defend themselves in federal cases for possessing marijuana, if they can show that they are using marijuana for medical purposes in line with relevant state laws. The Hill headline emphasizes that this legislation was co-sponsored by Ron Paul and Barney Frank....

"Other Republicans on the bill are Reps. Dana Rohrabacher (R-Calif.) and Justin Amash (R-Mich.). "Amash and Rohrabacher are not moderate Republicans, but strong conservatives....

"Recent polls have shown that more Americans than ever are fed up with the failed War on Drugs, with 18-29 years olds comprising the most irritated portion of the populace. These are the same young people who now flock to Ron Paul and his message."
