Alberta joins U.S. states' energy pact

Alberta premier Danielle Smith has signed on to the 12-state Governors' Coalition for Energy Security.

November 17, 2024 - "Alberta has become the first non-U.S. [political entity] to join a United States energy pact featuring 12 states that had already signed onto the coalition. Alberta Premier Danielle Smith made the announcement Thursday, personally thanking Louisiana Governor Jeff Landry and New Hampshire Governor Chris Sununu for inviting her, along with President-elect Donald Trump. Smith also thanked the other ten governors involved.

"Smith said that Alberta’s role in North American energy security is vital as the largest crude oil and natural gas supplier to the United States. 

With 200 billion barrels of recoverable oil, 200 trillion cubic feet of recoverable natural gas, significant natural gas liquids and ample pore space for carbon capture, Alberta’s contribution is set to grow even further as we look to work with the Trump Administration and other U.S. partners to increase our pipeline capacity to our greatest friend and ally, the United States.... We are proud to collaborate with this coalition of allied states in advancing energy security, reliability and affordability for Americans and Canadians....

"Alberta currently accounts for 56% of oil imports into the United States, double Mexico, Saudi Arabia, and Iraq combined.

"Landry said that the pact’s members share the goal of enhancing and protecting energy security, which he said will lead to lower energy costs, increased reliability, sustainable economic development, and wise management of energy resources and the environment. '

“I welcome Premier Smith and the insights she will bring as the leader from a fellow energy-producing province that, like my state, is under a federal system of government where national imperatives are not always aligned with state or provincial interests,' said Landry.

"The United States is the largest trading partner with Alberta, having $188 billion in bilateral trade in 2023. Energy products accounted for more than 80%, approximately $133.6 billion, of Alberta’s exports to the United States in 2023....

Alberta is a global leader in emissions reduction technologies and clean energy solutions. 'The province has captured about 14 million tonnes of carbon dioxide through carbon capture, utilization and storage technology, and has the ability to support the U.S. in developing new infrastructure and supply chains for future energy markets in the areas of hydrogen, renewables, small modular reactors and others,” reads Alberta’s press release. 

"The newly renamed Governors’ Coalition for Energy Security listed its goals in the press release issued by the Governor of Louisiana[:] ... 'to ensure families and businesses have the right to choose the energy they need, to minimize permitting and other regulatory barriers, limit expensive energy mandates, focus on affordability and reliability of energy infrastructure, and to coordinate to positively manage energy resources and the environment,' reads the press release....

"Smith issued an additional statement on Friday, saying she won’t wait for the [Canadian federal] Liberals to strengthen energy trade.... \

TN libertarians want school board transparency

Williamson County mother, libertarian group sue Tennessee School Boards Association under state Open Records Act | Chattanooga Times Free Press - Andy Sher:

December 18, 2019 - "In a case whose outcome could have major implications for some of the state's various local government associations, a libertarian group on Tuesday filed suit against the Tennessee School Boards Association, saying the organization should be subject to state public record laws.

"Suing on behalf of Williamson County parent and plaintiff Karrie Marren, the Beacon Center's legal arm is arguing the association acts as a 'functional equivalent of government, charged with training school board members in this state.' The suit charges that Marren was 'frustrated by the unresponsiveness' of Williamson County school board members who are 'legally mandated to receive their training and ethical standards from the Tennessee School Board Association.'

"As a result of the school board association's rejecting her request, the complaint says, Marren is suing under the Tennessee Public Records Act. The suit was filed in Chancery Court in Williamson County. TSBA's headquarters is in Williamson County.

"Braden Boucek, Beacon's vice president of legal affairs, said in a statement that 'taxpayers are entitled to transparency when it comes to how their children are educated and how their education tax dollars are spent.' He added that 'regardless of where you stand politically, transparency is one of the bedrocks of democracy, and any functional equivalent of government needs to be subjected to the same transparency laws. When a 'private' organization receives nearly all its money from taxpayers and gets preferential treatment to participate in the state's retirement program, they should be accountable to the very taxpayers who are funding them.'

"A favorable ruling could roil various local government associations in a state which has the Tennessee Municipal League for cities, the Tennessee County Services Association and other entities that provide similar services as Tennessee School Boards Association."

SCOTUS limits states' alcohol licensing powers

US Supreme Court rules state liquor laws are unconstitutional - Sam Bloch, The New Food Economy:

June 27, 2019 - "Generally speaking, the Commerce Clause of the Constitution allows for most foods to cross state lines. That’s not the case with liquor, though. Most states require salesmen to ... hav[e] lived within their boundaries for a given number of years. But ... [y]esterday, the Supreme Court decided that those residency provisions are unconstitutional, ruling against a Tennessee trade association by a 7-2 vote....

"The case began in 2016, when Total Wine, a Maryland-based liquor giant, and Affluere Investments, a small business owned by Doug and Mary Ketchum, each applied for licenses to sell liquor in Tennessee.... After the Tennessee Alcoholic Beverage Commission (TABC) approved their petitions, the Tennessee Wine and Spirits Retailers Association (TWSRA) appealed, saying that neither applicant was legally allowed to have a license. Tennessee is one of 35 states with a residency requirement for selling liquor. In this case, the trade association pointed out, neither applicant had been living in the state for two years. Additionally, the law requires 10 years of residency to renew the license, and for all company stakeholders to be residents, too.

"Lower courts found that Tennessee’s law was unconstitutional, but TWSRA took their suit against Russell F. Thomas, the commission’s executive director, all the way to the Supreme Court. The association said their law is protected by the second section of the 21st Amendment, which overturned prohibition. That particular section gives states the options to stop the import of liquor across their borders.

"And again, it’s failed to persuade the court. Justice Samuel Alito, writing for the majority of the court, said the state’s two-year residency requirement, which doesn’t have an effect on public health or safety, is unconstitutional, and a violation of interstate commerce laws.... The [21st Amendment] clause 'is not a license to impose all manner of protectionist restrictions on commerce in alcoholic beverages'....

"Tom Wark, executive director of the National Association of Wine Retailers, a trade association that had submitted an amicus brief, cheered the decision. 'State alcohol laws that discriminate against out-of-state retailers for the purposes of protecting in-state interests are unconstitutional and not protected by the Twenty-First Amendment. The decision is a historic win for both free trade and wine consumers across the country,' he said in a press statement."

Rangers shut down Tennessee park cleanup

Libertarians told to stop cleaning Shiloh National Military Park - Adam Friedman, Jackson Sun:

January 14, 2019 - "Members of the Libertarian Party in West Tennessee thought it would be nice to help clean up Shiloh National Military Park since most of the park's staff has been put on leave because of the partial government shutdown.

"But after less than 30 minutes of groundskeeping, they were told to leave.

"'Every other effort to clean up the national parks, from Washington, D.C., to Yosemite, has been fine," Tennessee Delta Region Libertarian Party Co-Leader Victoria Lee said. 'But when we went to Shiloh, we were told we were not allowed to clean up the park.'

"Lee, along with 25 other Libertarian Party members, and their families, went to Shiloh on Sunday to help clear off walking paths and rake leaves.

"The clean up at Shiloh is part of a nationwide initiative by the Libertarian Party to help clean up national parks around the country.

"'This is all in order to prove that volunteerism works,' Tennessee Delta Region Libertarian Party Co-Leader Marcus Baker said. 'Government isn't needed for everything; there are volunteers out there who can handle certain things. We all like keeping our national parks clean, simple as that.'

"A Shiloh National Military Park ranger can be heard saying in the video that he understands that the volunteers are trying to help but that volunteers can't clean up without a signed volunteer liability waiver.

"The Jackson Sun reached out to Shiloh National Park but has not received a response."

Tennessee Libertarians must run as independents

August 20, 2018 - "Vinnie Vineyard is a lot of things. Professional wrestler... Musician. Owner/operator of a small taxi cab business. What Vineyard is not, is a political independent but that’s the only description of him voters will get when they make their choice for Tennessee governor this November.

"Vineyard is a Libertarian, a philosophy that can basically be summed up by the idea that an action should be legal as long as it doesn’t harm others directly. 'We’re anti-crony capitalism. We don’t like corporations running the country,' he explained. 'We like smaller government. We think people should govern their own bodies ... healthcare needs to be opened up to the free market ... and pro-medical marijuana....'

"It’s a lot of information carried by a single word, but unless they’ve heard of him through his grassroots campaign, voters across the state will have no idea about Vineyard’s party affiliation.... And that’s the issue Vineyard and other Libertarian 'independents' across the state are trying to raise: Ballot access.

"In Tennessee, it is significantly easier to get on the statewide ballot as a Republican, a Democrat or an Independent than as a Libertarian or a member of the Green Party. Republicans, Democrats or independents only need 25 signatures on their petition to qualify for the ballot. To be listed as a Libertarian or Green Party member, the party itself would have to qualify as a 'minor' political party and the number of signatures required for that is nearly 40,000....

"'They want to limit Tennesseans choices, want to limit competition,' Vineyard said. 'Withholding that right to be identified hurts the voter, takes away their freedom and limits their choices'....

"And the labels are important, he said. When a voter goes to the ballot box, even if they know little about the individual they’re casting their ballot for, they know generically what a Republican believes, what a Democrat believes. Independent, however, carries no such brand recognition....

"While Vineyard knows improving ballot access won’t lead to a Libertarian wave this November, he did note that four Libertarian candidates won offices in the state in August and that he received more votes in the Republican Primary, in which he wasn’t running, than ... a longtime Republican who has run several long-shot campaigns for state and national office.

“'It’s planting seeds. There’s a new way to think, there’s not just two ways to think …,' he said. 'You don’t have to be assigned to one of two camps. I don’t like either one of them. They’re both terrible. They’re both full of hypocrisy and lies.'"

August 3, 2018 - "The next mayor of Knox County, Tennessee, will be a Big Red Monster. Glenn Jacobs, better known to pro wrestling fans as Kane, secured a victory last night against Democratic challenger Linda Haney.

"Prior to announcing his mayoral candidacy in April 2017, Jacobs spent a long and seasoned career as a WWE star. He has also had a long and seasoned career as a libertarian writer and activist. In a 2009 open letter to Chuck Norris, he encouraged [Norris] to back measures to 'End the Fed,' mirroring Ron Paul's denunciations of the Federal Reserve....

"Jacobs' byline has appeared on several libertarian and quasi-libertarian websites, including the Future of Freedom Foundation, LewRockwell.com, and Rare. He spoke at the Young Americans for Liberty's annual conference in both 2016 and 2017, and he has made several television appearances with the likes of Kennedy and Andrew Napolitano. He also co-founded a pro-market organization called the Tennessee Liberty Alliance.

"Though he ran as a Republican, Jacobs' campaign included many libertarian-friendly messages. 3 more Libertarians elected in Tennessee

Four more Libertarian officeholders | Libertarian Party:

August 6, 2018 - "The Libertarian Party has four new officeholders, three Libertarians who won elective office in Tennessee — two new county commissioners and a mayor. In Tennessee, arduous ballot access laws make it nearly impossible to get on the ballot as a Libertarian. So, these three enterprising Libertarians ran as independents and were successful at the ballot box. A fourth Libertarian has been appointed to a library board of trustees in Texas.

"In Montgomery County, Tenn., Joshua Beal was elected as county commissioner in District 14 on Aug. 2. Beal campaigned on bucking the status quo, taking on the good-ol’-boys’ network, and never voting for a property tax increase. Beal won with 54.6 percent of the vote....

"In Smith County, Tenn., Erika Ebel was elected as county commissioner in District 4. The top three out of the six candidates for the position were elected, so Ebel’s 23 percent of the vote propelled her into office.... She and her husband Cole, who serves as chair of the Tennessee Libertarian Party, own a restaurant in the district....

"In Trousdale County, Tenn., Stephen Chambers was elected as the county’s new mayor, with 55 percent of the vote, upsetting incumbent Mayor Carroll Carman.... Chambers campaigned on more efficient provision of essential county services and questioned the need for new nonessential services....

"In Dripping Springs, Texas, Yvonne Adams Schick was appointed to fill an open position on the board of trustees for the Dripping Springs Community Library. This is ordinarily an elected position, so Schick will run to retain her seat in the future.

"The Libertarian Party is running hundreds of candidates for local, state, and federal [offices] this year. The winning is just beginning."

May 2, 2018 - "On Tuesday, Glenn Jacobs — aka World Wrestling Entertainment star “Kane” — won a Republican primary by a razor-thin margin in his bid to become mayor of Knox County, Tennessee.

"Jacobs ... beat his closest Republican challenger by only 17 votes. There are still 43 provisional ballots to count before the victor is finalized, which might come as early as Thursday, and reports seem to strongly favor Jacobs’ chances....

"In deep-red Knox County, it is highly likely the Republican will best the Democrat mayoral candidate in the general election.... Tuesday’s primary all but decided who would become the next mayor, and it will likely be a nearly 7-foot tall professional wrestling 'demon,' who also is a well-established dedicated libertarian.....

"Jacobs operated a different kind of campaign, running on a pro-free market limited government platform, while also using his pro wrestling celebrity and libertarian-conservative brand to attract support from both inside and outside his county.

"A slew of famous pro wrestlers — The 'Nature Boy' Ric Flair, The Undertaker, Mick Foley, Chris Jericho, Daniel Bryan, the “Big Show,”Arn Anderson, Ricky Morton — all traveled to Knox County to hold fundraisers for their longtime colleague and friend, and doubled down on their support on election day, enabling the WWE legend-turned politician to draw more popular attention than most conventional Republicans.

"Before he became a mayoral candidate, Jacobs helped found the limited government Tennessee Liberty Alliance, was a regular on the libertarian program 'Kennedy' on Fox Business, a speaker for libertarian youth activist group Young Americans for Liberty, and ... spoke at the Foundation for Economic Education’s national conference in August. Jacobs was also endorsed by Rand Paul in May 2017....

"A mayor will obviously not have the same sort of national profile or impact as a U.S. senator or a congressman, but a figure with Jacobs’ celebrity who so openly embraces liberty ideas and policies is still another great representative for the libertarian faction within the Republican Party....

"There are other promising Liberty Republicans running this year — Maine’s '28-year-old wunderkind' state Sen. Eric Brakey who is challenging Sen. 22 Libertarians running for governor in Tennessee

April 9, 2018 - "Members of the Libertarian Party of Tennessee (LPTN) are taking drastic measures to show the public the absurdity of ballot access laws in the state. With 25 signatures required to run as a Republican, Democrat, or Independent, and 33,844 required to run as a 3rd Party, Libertarians across the state have decided to seek the office of governor running on a shared platform: make elections free and equal.

"'In Article 1, Section 5, the Tennessee state constitution declares that elections should be free and equal. Yet, only two parties have access to the ballot and rely on state-funded primaries for their nomination process. In order to be recognized on the ballot, the Libertarian Party is up against a threshold of 2.5% of the voters in the previous governor’s race, or 33,844 signatures.

"Cole Ebel, Chairman of the LPTN made this comment, 'We attempted to have that number lowered to 5000 through legislation, to make the ballots more free and equal. We even made a commitment to rely on privately funded caucuses, not state-funded primaries, to nominate our candidates. That effort was killed by legislative committee.'

"With the prospect of a legislative fix unlikely before the midterms, LPTN members have turned to alternative means to inform the public of the absurdity of Tennessee state law. With free and equal ballot access as their primary platform, 22 Tennessee Libertarians (pending signature approval) have announced their independent candidacy for governor."

Crowdfunding helps illegal barber pay $2K in fines

"Thanks to readers of Reason, Federal Communication Commission Chairman Ajit Pai, and other random strangers who had never met him, Elias Zarate was able to pay off a $1,500 fine (plus another $600 in fees) imposed by Tennessee's haircut cops.

"What crime warranted such a stiff penalty? Zarate cut hair without a ... high school diploma. What's finishing high school got to do with being a good barber, you may ask? Well, nothing, but Tennessee is one of 13 states to require completion of high school as a prerequisite to getting a barber license....

"Zarate dropped out of high school midway through the 12th grade to help raise his two younger siblings — their mother had died in a car accident and their father abandoned the kids to tenuous living arrangements with relatives — and ultimately got a job working as a barber in Memphis.... After getting busted, Zarate approached the Tennessee Board of Cosmetology and Barber Examiners, hoping for some help with getting a legitimate license. They slapped him with a fine and told him he'd have to go back to high school before he could work again. 'I was thinking, how am I supposed to pay for this fine, you know, because they're stopping me from working," Zarate told Reason....

"With the help of licensing reformers at the Beacon Center of Tennessee, a free market think tank, Zarate set up a GoFundMe account to help pay off his fine. After our story about his situation — and a clutch tweet from Pai — the page was flooded with donations.

"Zarate ended up raising more than $3,200, with most of it coming in the form of small donations from people who likely have never met him and never will.... 'I just want to thank everybody who donated, it means so much to me," says Zarate in a video posted by the Beacon Center. 'I just want to be able to get into barber school and make everything right with the state and provide for my family.'

"But now that Zarate has paid off his fines ... he's still no closer to having a career as a barber. Righting that wrong will require action from the state legislature. After Zarate's story became public, Gov. Bill Haslam called for a bill to reduce the educational requirements for a barbering license. Legislation introduced in the state House and state Senate would require the completion of 10th grade....

"It's not clear why there should be any educational requirement attached to a barber license. Cutting hair well does not require knowledge of trigonometry or a careful study of the meaning of The Adventures of Huckleberry Finn. Proper sanitation for the equipment used by licensed barbers — the only thing that could remotely be considered a reason for government to intervene — could be, and indeed is, taught during the mandatory training that all barber licensing applicants must complete in Tennessee. It is not taught in Tennessee high schools.

"The closer you look, the less sense it makes. You can become a licensed emergency medical responder in Tennessee without a high school diploma ... Getting an EMR license in Tennessee requires only that an applicant can 'read, write, and speak the English language,' according to Tennessee Department of Health guidelines....

"Individuals pitching in to help a guy like Zarate is a heart-warming story; but the reality is that state boards can issue more fines than could ever be paid off in such a fashion. Eliminating unnecessary licensing laws that have nothing to do with public health and safety is the only way to ensure that barbers, hair braiders, and cosmetologists in Tennessee and elsewhere have the freedom to pursue their careers without fear of the haircut cops."

March 15, 2014 - "The country should eliminate all income, corporate and payroll taxes and replace them with a consumption tax, Libertarian Party 2012 presidential nominee Gary Johnson told an audience today.

"'I believe that our lives would be changed for the better,' Johnson, a former Republican governor of New Mexico from 1995 to 2003, said during his keynote address before the Libertarian Party of Tennessee State Convention....

"When it comes to the consumption tax, Johnson said he’d like to abolish the Internal Revenue Service and told the audience that he agrees with the current proposed Fair Tax as a way to get started. The process would include getting rid of the 16th Amendment to the Constitution that allows income taxes and replacing them with a Fair Tax that would act like a 28 percent tax on all sales.

"The idea is revenue neutral, so there would still be a need to cut spending, said Johnson, noting that 165 members of Congress support the Fair Tax.

"The country should balance its budgets as a top priority and reform Social Security, Medicaid and Medicare, Johnson said."

Federal Judge lets TN Libertarian use party name on ballot

Federal Judge Rules: District 91 Candidate Tomasik Can Run as Libertarian | Politics Beat Blog | Memphis News and Events | Memphis Flyer - Jackson Baker:

October 31, 2013 - "Federal Judge William J. Haynes, Jr., chief judge of the Middle Tennessee district, ruled Thursday that the Shelby County Election Commission must list Jim Tomasik as a Libertarian Party candidate on the special election ballots for state House District 91 — not, as had previously been the case in preliminary listings, as an independent.

"The special election, which is scheduled for November 21, with early voting in effect from Friday, November 1, though Saturday, November 16, will pit Tomasik against Ramesh Akbari, who won the Democratic nomination for the seat in a special primary election on October 8. The election is to determine a successor to the late Lois DeBerry.

"In view of the closeness of the general election date, lawyers for Tomasik had sought an emergency injunction from Judge Haynes, who, after hearing arguments at a hearing Thursday, issued it from the bench."

October 24, 2012 - "For more than 80 years, the Free Press editorial page has been a voice for free market economic philosophies, personal responsibility and limited, responsible government. Endorsing the presidential candidate who most thoroughly represents those values has been an important function of the Free Press editorial page for nearly as long.

"For most of those election cycles, we have endorsed Republican candidates for president.... This election, however, the Republican Party nominee has failed to demonstrate a consistent commitment to conservative principles.... Mitt Romney is too flawed to earn the Free Press' endorsement.... Romney may be less eager to tax, spend, attack personal freedoms and disregard the constitutional limits on government than his Democratic opponent, President Barack Obama, but only slightly....
