Feds Can't Force You To Unlock Your iPhone With Finger Or Face, Judge Rules - Thomas Brewster, Forbes:

January 14, 2019 - "A California judge has ruled that American cops can’t force people to unlock a mobile phone with their face or finger....

""The order came from the U.S. District Court for the Northern District of California in the denial of a search warrant ... filed as part of an investigation into a Facebook extortion crime, in which a victim was asked to pay up or have an 'embarassing' video of them publicly released. The cops had some suspects in mind and wanted to raid their property. In doing so, the feds also wanted to open up any phone on the premises via facial recognition, a fingerprint or an iris.

"While the judge agreed that investigators had shown probable cause to search the property ... judge Kandis Westmore ruled ... that the government did not have the right, even with a warrant, to force suspects to incriminate themselves by unlocking their devices with their biological features. Previously, courts had decided biometric features, unlike passcodes, were not 'testimonial' ... because a suspect would have to willingly and verbally give up a passcode, which is not the case with biometrics. A password was therefore deemed testimony, but body parts were not, and so not granted Fifth Amendment protections against self-incrimination....

“'If a person cannot be compelled to provide a passcode because it is a testimonial communication, a person cannot be compelled to provide one’s finger, thumb, iris, face, or other biometric feature to unlock that same device,' the judge wrote. 'The undersigned finds that a biometric feature is analogous to the 20 nonverbal, physiological responses elicited during a polygraph test, which are used to determine guilt or innocence, and are considered testimonial....'

"Andrew Crocker, senior staff attorney at the digital rights nonprofit Electronic Frontier Foundation, said the latest California ruling went a step further than he’d seen other courts go....

"The magistrate judge decision could, of course, be overturned by a district court judge, as happened in Illinois in 2017 with a similar ruling. The best advice for anyone concerned about government overreach into their smartphones: Stick to a strong alphanumeric passcode that you won’t be compelled to disclose."

Libertarian-Democratic civil rights alliance emerging

Rand Paul's Crazy Dream of a Libertarian-Democratic Alliance on Civil Rights Is Actually Happening - Bloomberg Politics - David Wiegel:

January 29, 2015 - "On the morning before attorney general nominee Loretta Lynch would face Congress, Kentucky Senator Rand Paul re-introduced a bill that would tie her hands. Paul and a crew of congressmen — Minnesota Representative Keith Ellison, Michigan Representative Tim Walberg — had resurrected the Fifth Amendment Integrity Act. If passed, it would restrict the government’s ability, from the Department of Justice on down to local cops, to seize property from criminal suspects.

"'We’ve had protests across our country, and people think it’s about one or two instances,' Paul said from the rostrum. 'No. It’s one thing after another. Let’s say you’ve got a poor family in aneighborhood in a big city, and grandmother owns the house. The 15-year old son is selling marijuana. They catch him. They take the house! The house was the only stabilizing thing in a family that was having trouble.'

"Ellison, a black Democrat who was the first Muslim elected to Congress, stood by Paul as he summoned the ghosts of the Civil Rights movement.

"'Martin Luther King talked about there being two Americas, where one America was treated in a just fashion and one wasn't,' Paul said. 'At one point it was based on color, and it was awful. Now it’s not so much based on color on purpose, but there is an inadvertent sense to the war on drugs that has allowed people of color to be caught up in this.'

"This was Rand Paul, national figure and likely presidential candidate, and Democrats needed him. And this was still somewhat new to them. Paul had begun his Senate career in 2011 by slicing up red meat, introducing a doomed bill to ban abortions and a budget proposal that zeroed out foreign aid. He’d started the second Obama administration with a campaign of outreach to black students and black leaders, and a vocal campaign to restore the voting rights of felons. Democrats could say this and the media shrugged; Rand Paul said it, and the notebooks came out."

Rand Paul introduces bill to limit asset forfeiture

Sen. Paul Introduces the FAIR Act - Rand Paul | United States Senator (Press release):

July 24, 2014 - "Sen. Rand Paul yesterday introduced S. 2644, the FAIR (Fifth Amendment Integrity Restoration) Act, which would protect the rights of citizens and restore the Fifth Amendment's role in seizing property without due process of law. Under current law, law enforcement agencies may take property suspected of involvement in crime without ever charging, let alone convicting, the property owner. In addition, state agencies routinely use federal asset forfeiture laws; ignoring state regulations to confiscate and receive financial proceeds from forfeited property.  

"The FAIR Act would change federal law and protect the rights of property owners by requiring that the government prove its case with clear and convincing evidence before forfeiting seized property. State law enforcement agencies will have to abide by state law when forfeiting seized property. Finally, the legislation would remove the profit incentive for forfeiture by redirecting forfeitures assets from the Attorney General's Asset Forfeiture Fund to the Treasury's General Fund.

"'The federal government has made it far too easy for government agencies to take and profit from the property of those who have not been convicted of a crime. The FAIR Act will ensure that government agencies no longer profit from taking the property of U.S. citizens without due process, while maintaining the ability of courts to order the surrender of proceeds of crime,' Sen. Paul said."

Police seize millions from motorists never charged with crimes

Cops Use Traffic Stops To Seize Millions From Drivers Never Charged With A Crime - Nick Sibilla, Institute for Justice, Forbes:

March 12, 2014 - "A deputy for the Humboldt County’s Sheriff Office in rural Nevada has been accused of confiscating over $60,000 from drivers who were never charged with a crime.  These cash seizures are now the subject of two federal lawsuits and are the latest to spotlight a little-known police practice called civil forfeiture.

"Civil forfeiture allows law enforcement to seize property (including cash and cars) without having to prove the owners are guilty. Last September, Tan Nguyen was pulled over for driving three miles over the speed limit, according to a suit he filed.  Deputy Lee Dove asked to search the car but Nguyen said he declined.  Dove claimed he smelled marijuana but couldn’t find any drugs.  The deputy then searched the car and found a briefcase containing $50,000 in cash and cashier’s checks, which he promptly seized.... Nguyen was not arrested or charged with a crime — not even a traffic citation....

"Unsurprisingly, seizing cash from traffic stops can earn millions for law enforcement.... Bob Vogel ... seized $6.5 million in cash from cars going southbound on I-95 in Volusia County, Florida. But usually the cars that smuggled drugs went northbound. Plus, part of the 'drug courier' profile for Sheriff Vogel 'was that cars obeying the speed limit were suspect — their desire to avoid being stopped made them stand out.' The Orlando Sentinel later found that in three out of every four cases, no charges were filed."
