Colorado abolishes death penalty

Colorado to Become 22nd US State to Abolish Death Penalty | Voice of America:

February 27, 2020 - "Colorado is set to become the 22nd U.S. state to abolish the death penalty. Lawmakers gave final approval to a bill to end the practice Wednesday, and the state's governor has said he will sign it.

"Proponents of halting the use of the death penalty argued it is a punishment that cannot be reversed if later evidence emerges showing someone is innocent, and that it is disproportionately applied to minorities and the poor.

"Those who wanted to keep capital punishment as a sentencing option said the threat of the death penalty gave defendants incentive to seek agreements to plead guilty to crimes and accept lower sentences....

"The state last executed someone in 1997.  Nationally, there have been four executions this year.

Last year, the state of New Hampshire abolished the death penalty, while California Governor Gavin Newsom said last year there will be no capital punishment while he is in office."

July 26, 2019 - "Rep. Justin Amash, I-Mich., who left the Republican Party over his feud with President Donald Trump, has teamed up with a member of the anti-Trump 'squad' to keep the Department of Justice from executing five convicted murderers.

“'Michigan abolished capital punishment in 1846,' Amash tweeted Friday morning. 'The U.S. government has had a moratorium on this horrendous practice since 2003. Now, President Trump and AG Barr want to resume executions. This week, I joined @RepPressley to introduce a bill to prohibit the federal death penalty.'

"The short bill, less than two pages, simply states that 'no person may be sentenced to death or put to death on or after the date of enactment of this Act for any violation of federal law.'

"The move is in response to a Department of Justice announcement Thursday that the Trump administration would seek to carry out the first federal executions in 16 years....

"Rep. Ayanna Pressley, D-Mass., is a member of the far-left group of House Democrat freshmen known as the 'squad.' She responded to Thursday’s news by bringing up President Trump’s calls, when he was a private citizen, to bring back the death penalty for the Central Park Five....

"The death row inmates in this situation, according to Thursday’s announcement, have been convicted of murdering 'the most vulnerable in our society — children and the elderly'....

"The last person to be executed by the federal government, as opposed to a state government, was in 2003. While Obama stopped short on efforts to put an end to the practice at the federal level in 2015, his administration put a de facto moratorium on executions."

July 21, 2019 - "When the Council of Ex-Muslims of Britain (CEMB) started ... in June 2007, we were hard pressed to find 25 people who would come out publicly to break the apostasy taboo.... Today, we are witness to an international ex-Muslim 'community' – a tsunami of atheism.

"For me, though, this has never been about community as identity politics (people boxed into homogenised, segregated communities with culturally-relative rights managed by 'community leaders'). But rather, a community in protest: insisting on freedom from religion and the right to conscience ... a movement that insists on our common humanity and equality – not difference or superiority. A movement of people who refuse to live in fear and in the shadows. And who are speaking out for social change in unprecedented ways, particularly via social media.

"This movement matters because thirteen states punish atheism with the death penalty – all Islamic.... Because a series of laws in Saudi Arabia define atheism as terrorism with Ahmad Al-Shamri being sentenced to death for atheism.... Because Sina Dehghan has been sentenced to death in Iran for 'insulting Islam'.... Because a Pakistani High Court Judge has said that blasphemers are terrorists with Ayaz Nizami and Rana Noman facing the death penalty. This movement matters because you can be killed for leaving or criticising Islam....

"Yet when CEMB took to the streets of London Pride last year, the East London Mosque filed a complaint against our 'Islamophobic' placards.... when #ExMuslimBecause became viral overnight with over 120,000 Tweets from 65 countries with so many realising they were not alone for the first time in their lives, BBC Trending said it was an excuse for 'Muslim-bashing' and 'Islamophobia' ... when we showed our solidarity with those persecuted in Saudi Arabia for eating or drinking during Ramadan, armed metropolitan police came to the Saudi Embassy’s rescue saying our 'eat-in' and fast-defying solidarity action was “offending” those at the embassy …

"In my opinion, accusations of 'Islamophobia' are less about opposing bigotry (after all you cannot stop racism by outlawing blasphemy and apostasy) and more about defending religious privilege and the status quo. It is used to scaremonger ex-Muslims into silence and impose de facto apostasy and blasphemy laws where none exist. Where they do, we are accused of blasphemy and apostasy and persecuted without any such 'niceties'....

"The charge of 'Islamophobia' protects religion and the religious-Right, not believers.... Conflating criticism of Islam and Islamism with 'Muslim-bashing' sees dissent as bigotry rather than for what it is – a defence of blasphemy and apostasy when one can be killed for it.

"That doesn’t mean that bigotry against Muslims, migrants, minorities doesn’t exist. Of course it does..... And, yes of course, there are ex-Muslims who are bigoted against Muslims just as there are Muslims who are bigoted against ex-Muslims.... But individuals – not a 'community' –  must be held accountable for their choices. We are not extensions of our 'communities' to be defended or condemned depending on which 'tribe' we belong to....

"Whilst touted as progressive, identity politics is a politics of difference AND superiority – these are two sides of the same double-edged sword. The politics of difference has always been the fundamental principle of a racist agenda, not the other way around – whether it is Nazism, the biological theory of difference and racial superiority or expressions of difference in cultural and religious terms. Identity politics is the corruption of the fight for social justice by degrading it to a mere defence of culture and the homogenous 'community' – no matter what.

"In an age of regressive identity politics and cultural relativism, an ex-Muslim community in protest matters because it reaffirms universal values, anti-racism, secularism, the fight for equality, social justice and our common humanity. A movement that is about equality not privilege. Rights without permission. And gives no apologies."

WA Supreme Court strikes down death penalty

October 18, 2018 - "The Washington Supreme Court unanimously struck down the death penalty last week, ruling that it is 'imposed in an arbitrary and racially biased manner.' In doing so, Washington becomes the 20th state to end capital punishment. The ruling commuted the sentences of eight men currently on death row to life in prison.

"'The death penalty, as administered in our state, fails to serve any legitimate penological goal,' the ruling states.

"It's the third time the court has declared the state's death penalty laws unconstitutional — the prior rulings taking place in 1972 and 1979. None of those, including last week's decision, hold capital punishment as inherently unconstitutional. The court left open the option that the state Legislature could enact a statute for capital punishment, as long is it doesn't create a system that offends constitutional rights....

"Fifteen states have abandoned the death penalty through court order or legislative act in the last 15 years. Washington has not executed anyone since 2010, and in 2014, Washington Gov. Jay Inslee — a one-time supporter of capital punishment — imposed a moratorium on the death penalty. He said last week in a news conference that he would veto any bill that would reinstate the death penalty. "'Today's decision by the state Supreme Court thankfully ends the death penalty in Washington,' Inslee says in a statement....

"Washington Attorney General Bob Ferguson, who introduced legislation in 2017 to abolish the death penalty, says in a statement he will try again to remove capital punishment from state law, 'once and for all.'  'Next session, I will again propose legislation repealing the death penalty, replacing it with life in prison without the possibility of parole,' Ferguson says."

Pakistani Christian on death row for blasphemy freed by Supreme Court

October 31, 2018 - "Pakistan's highest court on Wednesday ordered the release of a poor, illiterate Christian woman who had been sentenced to death for blasphemy, setting off a wave of demonstrations by hard-line Islamists nationwide but drawing praise from human rights activists.

"The Supreme Court overturned the conviction against Asia Bibi, accused in 2009 of insulting the Prophet Muhammad in a case that sparked violent protests in the overwhelmingly Muslim nation of 200 million people. Two Pakistani government officials were murdered in 2011 in crimes linked to their support of Bibi....

"Chief Justice Saqib noted that tolerance is the 'basic principle' of Islam. Pakistan Peoples Party leader Sherry Rehman cheered the verdict on Twitter.... But the future of blasphemy laws in Pakistan is far from settled. The laws remain popular in Pakistan, and Prime Minister Imran Khan expressed support for them during the recent election campaign.

"After the decision on Bibi was announced, the Islamist political party Tehreek-e-Labaik said Saqib and the other judges deserve death under Islamic law. That drew a sharp rebuke from Khan. 'The state will fulfill its responsibility of protecting the lives and properties of people and take strict action against violators,' he said in a speech broadcast across the country....

"Bibi's case stemmed from a simple act among poor farmhands in rural Pakistan.... Muslim women working with Bibi complained when she dipped her cup into the water bucket, saying a non-Muslim was unclean. The women quarreled, and her co-workers accused her of insulting the prophet three times. She was later beaten, and the women complained to a local religious leader who pressed for the blasphemy charge. Insulting Islam's prophet is considered blasphemy [and] carries a death sentence under Pakistani law....

"The United States Commission on International Religious Freedom hailed the decision and urged Pakistan officials to take steps to ensure her safety. The group also called for release of the estimated 40 people who remain on death row for blasphemy convictions. Blasphemy laws protect entire religions rather than the rights of individuals, falling short of international human rights standards, commission chairman Tenzin Dorjee said.

"Amnesty International called the decision a 'landmark verdict' for religious tolerance. 'Pakistan’s blasphemy laws are overbroad, vague and coercive,' the group said in a statement."

June 25, 2018 - "‘"Abolish ICE!" [Immigration and Customs Enforcement] is the new rallying cry for progressive Democrats,' reports NBC News’s Alex Seitz-Wald. It’s 'a radical idea and one that was confined to the fringes just months ago,' but one that 'left-wing insurgents can use to differentiate themselves from more established rivals in Democratic primaries.”

"Good idea. So good, in fact, that I wrote a column advocating exactly that three months ago. Welcome to the right side, Democrats.

"Like most Libertarians, I’m amused when our ideological opponents see a parade forming around one of our ideas and try to hustle their way to the front to 'lead' it. Unlike some Libertarians, I don’t follow up amusement with getting down in the mouth about being 'co-opted.' I’m just happy to see good ideas gain steam from any source.

"The Libertarian Party has supported same-sex marriage rights since its founding in 1971. Hillary Clinton finally joined us on that one in 2013.....

"We began calling for elimination of the federal income tax decades before the (even worse) 'Fair Tax' idea embedded itself in the Republican Party....

"Marijuana legalization? That was us too, fighting both old party establishments to get medical, then recreational, cannabis off the list of victimless 'crimes' from the early 1970s on....

"We beat the Democrats to putting abolition of the death penalty in our platform by mere weeks in 2016. It should have been there since 1971.

"The perceived gold standard for a political party’s success is winning elections, and I wish Libertarians won more of them. But a better standard is successfully pushing our values, ideas, and proposals into the public conversation and seeing them adopted. I’d like to see that happen more often as well, but I’m glad when it happens at least occasionally."

October 24, 2016 - "When the Trump campaign imploded, I finally felt it was safe to come out as a supporter of Gary Johnson.... The response was more hostile than if I’d announced I was engaged to Kim Jong Un.

"'I’m genuinely concerned you’ve lost your mind,' wrote my pro-Clinton friend Eliza....  I knew Eliza opposed the death penalty, so asked her why she was voting for Clinton, who still believes the government can kill people legally. When I showed her that, unlike Johnson, Clinton is indeed a cheerleader for lethal injections, Eliza went silent.

"Capital punishment is just one issue where many Americans, in their heart of hearts, may well agree more with Johnson than with ClinTrump. Peace is another one. Hawkish Hillary voted for the Iraq war, backed military action in Libya and sending American troops into Syria. Trigger-happy Trump also gave the Iraq war a thumbs-up.... Johnson opposed the Iraq war, and has pledged to slash the military budget ... scale back on nuclear programs, close down some foreign bases and end foreign invasions.

"Johnson is a far braver free-speech advocate than ClinTrump. He has been steadfast in his opposition to the Patriot Act, censorship of the Internet, militarization of the police and the indefinite detention of prisoners. In 2012, the American Civil Liberties Union gave him the highest score of any presidential candidate....

"Johnson is the champion of the challenge to the bankrupt two-party system, with which millennials are so fed up. That’s especially true with Social Security ... an entitlements program that is heading off a cliff.... 'Millennials are getting screwed,' Johnson warns.... The same is true with healthcare. As Johnson said: 'President Obama’s affordable healthcare is dependent on young healthy people paying for older unhealthy people'....

"On education, Johnson ... will completely abolish the grossly wasteful Department of Education and will expand vouchers for private schools. Unlike Clinton, his plan favors teachers over unions; local educational processes over federalized testing.

"Johnson is passionate in his belief that the Federal government should stay out of both your bedroom and your wallet. That is most apparent in his tax plan, which would eliminate the IRS and replace most of the tax code with a single consumption tax. He’s promised to submit a balanced budget to Congress within his first 100 days in office....

"Johnson could win the White House it if he prevails in just one state, and neither Clinton nor Trump secures 270 electoral college votes.... Terror of this scenario is what’s brought out the Obamas to turn their sights on Johnson and led the liberal-limousine echo chamber to sink to personal insults. Bill Maher recently called Johnson a 'ventriloquist dummy' and a 'fucking idiot.' John Oliver drank the two-party Kool-Aid, laid into Johnson as 'weird… an ill tempered mountain-molester with a radical, dangerous tax plan.' David Remnick, editor of the New Yorker, called him 'the least informed candidate for the presidency'.... The Clinton propaganda machine and their loyal media supporters ... hammered Johnson [and] MSNBC ... organized a Gotcha-ism orgy."

May 27, 2015 - "Nebraska on Wednesday became the first conservative state in more than four decades to repeal the death penalty. Its legislature, officially non-partisan but dominated by Republicans, voted by the narrowest of possible margins to override a veto by Governor Pete Ricketts, and enact a law scrapping a punishment that the state has struggled to carry out....

"In the end, a growing coalition of liberals, religious groups, and libertarian-minded conservatives overcame more traditional tough-on-crime Republicans who saw the death penalty as the appropriate, ultimate punishment for murder. Underlying that ideological debate, however, was a far more pragmatic consideration. Nebraska has been unable to kill any of the murderers sentenced to death by its legal system since 1997.... That failure has given momentum to opponents of capital punishment, including a new group of conservatives that has invoked fiscal and religious arguments to woo right-leaning legislators to their side.

"'It’s not just about the procurement of drugs,” said Marc Hyden of Conservatives Concerned About the Death Penalty, an organization that sprouted up in Montana several years ago and has since expanded nationally. 'It’s not pro-life because it risks innocent life. It’s not fiscally responsible because it costs millions more dollars than life without parole.'

"Yet Nebraska's bumbling and occasionally shady attempts to carry out death sentences — along with incidents in neighboring states like the botched execution of Clayton Lockett in Oklahoma — have given rise to another argument that sells among conservatives: the death penalty is just another example of government run amok.

"'At the end of the day, this is just another big government program that’s really dangerous and expensive but doesn’t achieve any of its goals,' Hyden told me, summarizing his pitch to Republicans. 'They don’t need to ask themselves, "Do some people deserve to die?" The question they need to ask themselves is, do they trust an error-prone government to fairly, efficiently and properly administer a program that metes out death to its citizens? I think the answer to that is a resounding no'...

"'This has been a slow, steady move toward repeal,' said Stacy Anderson, executive director of Nebraskans for Alternatives to the Death Penalty. Danielle Conrad, executive director of the state chapter of the ACLU, cited the state’s unicameral, non-partisan legislature — unique in the U.S. — and a recent term-limits law that facilitated the election of more libertarian-leaning senators in recent years."

Canadian wrongfully convicted of murder released after 12 years in prison

'Nightmare' over for man wrongfully convicted of 1st-degree murder decade ago - Winnipeg Free Press - Colin Perkel, Canadian Press:

"A man wrongfully convicted of first-degree murder more than a decade ago took his first anxious steps as a free man on Friday after the Crown withdrew the charge against him.

"The decision came a year after the Supreme Court of Canada unanimously decided Leighton Hay should get a new trial based on new hair evidence.

"As Hay and family members looked on, Superior Court Justice John McMahon apologized that it took so long for the system to get it right....

"In an interview, lawyer James Lockyer said he wasn't sure his client was able to process the implications of what had just occurred.

"'Leighton has been through a nightmare for all these years,' Lockyer said. 'This was a miscarriage of justice of the highest order.'

"As a teen with mental-health problems and a member of a visible minority, the lawyer said, Hay was 'vulnerable" and police rushed to judgment.

"'He was another black guy,' Lockyer said."

Sep. 14, 2011 - "Davis was convicted in 1991 of the 1989 murder of Savannah police officer Mark MacPhail. But there was no physical evidence brought to trial to support his conviction: No murder weapon, no DNA evidence, no surveillance tapes.

"Nine so-called eyewitnesses testified in the trial, and it was on the basis of their testimony that Davis was sentenced to death. Seven of those witnesses, however, have since recanted or materially changed their stories. The jury, for instance, relied on two people ... who testified that Davis had confessed to the shooting; both have since said they were lying.

"[The] U.S. Supreme Court took the extraordinary step of ordering a lower court to conduct an evidentiary hearing in the case. But the federal judge ... then required Davis to prove that he was innocent."
