Hillier ruling strengthens Charter right of assembly

In this year's case of Hillier v. Ontario, for the first time ever, a Canadian court has invoked the Charter right of peaceful assembly to overturn a law as unconstitutional.

April 10, 2025 - "Since lockdowns were imposed in March 2020, governments across Canada have admitted in numerous court challenges that provincial and federal health orders did violate one or more of the Charter freedoms of conscience, religion, expression, peaceful assembly, association, and mobility. In like manner, governments have admitted that vaccine mandates violated the Charter right to bodily autonomy. Canadian courts have consistently upheld these Charter violations as being reasonable and justified in a free and democratic society — until the Ontario Court of Appeal delivered its judgment in Hillier v. Ontario on April 7.

"Randy Hillier, a former Member of Ontario’s Provincial Parliament, challenged Ontario’s total and absolute ban on all outdoor protests, which the government imposed on citizens in April and May of 2021. While up to 10 people could gather for a wedding or funeral, or for a religious service or ceremony, it was illegal for two people to meet outdoors for a peaceful protest!

"Mr. Hillier faced charges and fines up to $100,000 for organizing peaceful political protests in Kemptville and Cornwall, and for attending protests in Smiths Falls, Belleville, Peterborough, Stratford, Kitchener, and Chatham throughout April and May 2021. His defence to these charges was that Ontario unjustifiably restricted his Charter freedom of peaceful assembly. In court, Ontario presented no evidence that its total ban on outdoor protests, including those in which Mr. Hillier participated, would reduce the spread of Covid.

"Overturning the November 2023 lower court ruling, Court of Appeal Justices Lauwers, Zarnett, and Pomerance ruled unanimously that Ontario’s absolute ban on peaceful assembly in 2021, particularly outdoor political protests, was an unjustified violation of the freedom of peaceful assembly as protected by Section 2(c) of the Charter.... The court declared that it could not countenance 'an outcome in which the state eliminates the free exercise of a fundamental freedom, without giving that elimination any actual thought'.... While stating that 'the pandemic posed significant challenges for Ontario,' the court declared that 'the Constitution does not fade from view in times of crisis.' 

"For the first time in Canadian judicial history, an appellate court has outlined the nature, purpose, and benefits of the Charter section 2(c) freedom of peaceful assembly, declaring it 'elemental' and 'integral to a functioning democracy.' Previously, peaceful assembly has been ignored and subsumed into the other Charter section 2 freedoms.... Peaceful assembly differs from the other fundamental freedoms because 'a demonstration is an act of solidarity, a coming together of similarly minded individuals,' who can 'make visible the extent and depth of support for a position,' the ruling said.

"The freedom of peaceful assembly protects the ability of citizens to get the community to pay attention to their message of protest or dissent, and entice others to become involved in redressing grievances. The court noted that 'outdoor protests are especially effective at amplifying minority voices and expressing political dissent.' Ontario’s total ban on peaceful protests denied citizens of their 'opportunity to influence public policy by this time-honoured method.' Significantly, the court ruled that social media and virtual gatherings ... cannot replace the 'traditional means of participating in public assemblies'..... 

"Governments across Canada have been put on notice that they cannot ban peaceful political gatherings. Freedom-loving Canadians can be encouraged that the Ontario Court of Appeal has elevated a previously 'forgotten freedom' to overturn a Covid-era ban on the exercise of that same Charter freedom. Could protection of Charter freedoms in Canada be making a comeback?"

2022 Convoy charges against Randy Hillier stayed

On November 14 an Ontario Superior Court judge ruled that all charges against Randy Hillier stemming from the 2022 Freedom Convoy be dropped, agreeing that Hillier's Charter right to be tried within a reasonable time frame had been violated.

November 18, 2024 - "All charges against former MPP Randy Hillier relating to the February 2022 convoy protest in Ottawa have been stayed.... Hillier, who represented Lanark-Frontenac-Kingston as an independent after being removed from the Conservative caucus in 2019, had been facing a nine-pack of charges stemming from the trucker blockade along Wellington Avenue in front of Parliament Hill. The charges included two counts of mischief, three counts of counselling to commit an indictable offence, three counts of obstructing a police officer and one count of assaulting a police officer.

"In a ruling dated Thursday, Superior Court Justice Kerry McVey agreed with Hillier’s argument that his Charter right to be tried within a reasonable time frame had been violated. A four-week trial had been scheduled to begin next Jan. 27 in Ottawa, with an anticipated ending of Feb. 25. That would amount to a total of 34 months 28 days since police charged Hillier. Factoring in 105 days for delays caused by the defence and for 'exceptional circumstances,' McVey ruled that Hillier had been waiting for 31 months 13 days for a trial. 

"A previous 30-month ceiling on delays had been established by the Supreme Court in the 2016 decision R v. Jordan. 'As a result, the application is granted,' McVey wrote. 'The charges against Mr. Hillier are dropped'....

"The case against Hillier included charges that he inspired his 56,000 online followers to flood non-emergency police lines during the convoy protest demonstration despite a police plea to the public to keep communication channels open. Police had received 274 malicious calls during a six-day period, according to the Crown case. Hillier had told his on-line supporters to keep calling because 'in a democracy, expressing yourself is a fundamental freedom.'

"The prosecution also said Hillier had disregarded a police officer’s directions and used his shoulder to push an officer away, allowing demonstrators to pass through a barricade.

"Despite emergency orders against it, the Crown also contended that Hillier told his supporters to continue stocking the protesters with gasoline and food."

Ontario Crown drops more Covid-related charges

Ontario pastors and former MP have 2021 lockdown tickets stayed | Western Standard | Lee Harding:

March 8, 2024 - "Some prominent Ontario activists who attended outdoor anti-lockdown rallies in 2021 have had their tickets stayed with help from the Justice Centre for Constitutional Freedoms.

"On May 8, 2021, former Member of Parliament Derek Sloan attended an outdoor anti-lockdown rally, organized by No More Lockdowns Canada. That rally attracted close to 1,000 participants.... On May 30, Pastor Henry Hildebrandt of the Church of God in Aylmer, Ontario participated in a similar outdoor rally in Woodstock, ON, attended by an estimated 350 people. 

"Both rallies were peaceful. There were no criminal charges, only tickets for violating the Reopening Ontario Act, which placed a total ban on indoor and outdoor gatherings during the spring of 2021, although there was no evidence to show that outdoor gatherings were significant contributors to the spread of COVID-19. 

"Sloan had faced charges for participating in peaceful protests across Ontario, in Stratford, St. Thomas, Chatham and Woodstock. All charges have been either stayed or withdrawn at the request of the respective prosecutors.... Hildebrandt spoke at many peaceful outdoor rallies during the lockdowns and was charged more than six times in the first half of 2021 with violating the Reopening Ontario Act.  

"Pastor Nathaniel Wright of the nearby Crossroads Alliance Church was charged with holding a church service on May 2, 2021. All charges against him were stayed in the same jurisdiction, Woodstock, on February 15, 2024. Wright was also involved in the resolution of the Trinity Bible Chapel case, where all charges against him were stayed for protests in Kitchener-Waterloo. The Justice Centre provided lawyers to defend these pastors who received tickets for exercising their Charter freedoms. All cases involving Sloan and Hildebrandt are now resolved.... 

"Hildebrandt previously pled guilty to defying the Reopening Ontario Act by holding an outdoor church service on June 6, 2021.... As a result of Hildebrandt's guilty plea in August 2023, related charges against him, his family, the Church of God, other church members and former politicians Sloan and Randy Hillier were dropped. Hildebrandt had to pay a $52,000 fine and a $13,000 victim surcharge."

Last charges finally dropped on 2022 protests at Ambassador Bridge | Western Standard | Lee Harding: 

March 8, 32025 - "An Ontario Crown attorney has withdrawn all criminal charges against William Laframboise, an alleged leader of the Windsor protests that blocked the Ambassador Bridge in February 2022. While the Crown attorney stated that there were triable issues, he also explained to the court that it was not in the public interest to prosecute Laframboise given the evidentiary challenges of the Crown’s case and other serious matters that were vying for trial time in a backlogged court system.

"The Democracy Fund (TDF) litigation director, Alan Honner, stood beside his client, LaFramboise, as the charges were withdrawn before Justice Campbell. 'Mr. Laframboise has always maintained his innocence,' says Honner. 'He insisted on his right to trial and we believe he would have been acquitted had the charges not been dropped.'

"A six-day blockade at the Ambassador Bridge that links Windsor, ON to Detroit, MI took place in February of 2022.... 

"Laframboise was arrested approximately six months after the fact. His arrest was the result of an ongoing police investigation which sought to identify an organizer of the protests.... Nycole Dicredico and William Laframboise were charged with mischief in connection with leading the blockades. However, Dicredico's charges were dropped in November shortly before trial at the Ontario Court of Justice."

Covid charges dropped against Sloan and Hillier

Charges against former MP Derek Sloan and former Ontario MPP Randy Hillier for attending a banned "No More Lockdowns" 2021 protest in Stratford, Ontario, have been dropped by the Crown.

July 12, 2023 - "The Justice Centre for Constitutional Freedoms is pleased to announce that charges against Mr. Derek Sloan and Mr. Randy Hillier were dropped on Thursday, June 29, 2023.  Both men allegedly attended a rally against Covid-19 lockdown measures in April 2021.

"On April 8, 2021, the Ontario government declared a state of emergency over increasing cases of Covid-19. The government then implemented its most draconian measures yet by instituting an outdoor gathering ban which effectively made peaceful political protest illegal in Ontario. Mr. Sloan was a former MP, and Mr. Hillier was a sitting MPP at the time. Both believed that these lockdowns were harmful and attended these gatherings to protest the measures.  

"On April 25, 2021, there was a 'No More Lockdowns' protest in Stratford, which the 2 men attended. At the time, the Ontario government’s regulations stated that zero persons were allowed to gather outdoors.... The Ontario government did this despite the fact most experts agree that spread of respiratory viruses at short duration, outdoor events are extremely limited. Mr. Sloan and Mr. Hillier each faced a maximum fine of $100,000 for attending this protest. 

"The prosecutor agreed to drop the charges in exchange for a modest charitable donation or volunteer work.  Mr. Sloan made the charitable donation and Mr. Hillier volunteered at a food bank in Lanark County.

“'The Ontario government’s lockdowns, which effectively banned any political protesting whatsoever, were a grave threat to our freedom in Canada. Restrictions may be over for now, but there was no indication how long they would last at the time. 2 weeks became 2 months which became almost 2 years of failed COVID policies.', says Mr. Sloan. 'I am proud to have stood against this tyranny with many other brave Canadians. 

"'The Stratford prosecutor made the right choice, and it is now up to other prosecutors in other districts to drop these meaningless charges. One day, history, and the courts, will concur that these lockdowns were unwarranted and a serious and unnecessary interference with Canadian’s basic freedoms,' he continued. 

"Both Mr. Hillier and Mr. Sloan have similar outstanding charges in Ontario. Mr. Hillier has launched a Charter challenge against the lockdowns that banned all outdoor protests, and will argue that they were an unjustifiable infringement of his rights. The hearing is set for July 27-28, 2023."

March 29, 2022 -"I’ve known Ontario MPP Randy Hillier for about 20 years. I’ve found myself in agreement with him on every important issue I can think of over that time. The pandemic was no exception. I admired his courage in publicly opposing Ontario’s official government narrative about lockdowns, mask mandates and vaccination mandates. I applauded his denunciation of the tyrannical federal policies that led to the Ottawa Freedom Convoy. 

"Therefore, when I received a message early Monday morning (March 28) saying that Randy was being charged with nine Criminal Code offences ... and would be surrendering to the Ottawa police that day, I was alarmed. I knew he had been accumulating provincial charges for various No More Lockdowns protests he had organized and attended around the province, but sources have been telling me that many charges of this kind are being delayed and ultimately dropped by prosecutors who don’t want to face a well-thought-out Charter challenge. Criminal Code charges by the Ottawa police were a different kettle of fish. My concern, of course, was Randy might face the kind of treatment that had been given to convoy organizer Tamara Lich, who spent two weeks in jail before finally receiving reasonable bail conditions.

"Randy retained Ottawa criminal lawyer David Anber, and a bail hearing was held via Zoom on Monday afternoon. Anber had already negotiated with Crown counsel Tim Wightman and they had hammered out an agreement under which Randy would be released on bail subject to 15 conditions he’d have to comply with. Counsel were able to agree on the wording of 14 of those conditions: standard bail terms such as posting a bond (in this case, $35,000), residing with his surety at a fixed address, not communicating with other people who have been charged with offences also arising out of the Freedom Convoy, and so on. However, they couldn’t agree on the wording of the fifteenth condition, namely what Randy would be permitted to say on social media pending trial about the issues he has been expounding on over the past two years.

"I managed to get into the Zoom call and listened to the legal arguments. The Crown wanted to restrict Randy from posting anything 'on social media of any type' regarding not only the Freedom Convoy, but also provincial policy on mask mandates, vaccination mandates, 'or the Anti-vaccine cause [sic].' He also wanted to prevent Randy from attending or providing 'any type of support (including financial support) to the freedom convoy or any anti mask/vaccine organization or causes [sic].' Anber pointed out as an elected member of the legislature, it was actually Randy’s job to comment precisely on important issues like this before the legislature. He also argued that in a free and democratic society, it’s important to have competing voices saying different things about the issues.

"The Crown prosecutor then seemed to narrow down what he was asking for. It’s forbidden on Ontario court Zoom calls to make your own recordings of the proceedings, so I had to type furiously in an effort to catch what he was saying. He seemed to concede that the wording of the disputed bail condition would not prevent Randy from making his views heard in the mainstream media or in the legislature only on social media, which the Crown described as his primary tool of communication.

"This isn’t much comfort. For starters, how is social media defined nowadays? I no longer get paper copies of major daily newspapers delivered to my door. I read them online, and frequently participate in the online comment sections. Does the electronic interaction between a newspaper and its readers nudge the paper over the line into the social media category? Is clicking a 'like' button part of 'posting?' What about sharing someone else’s post? It’s not entirely clear what will be forbidden, and the stakes would be high if Randy were to be accused of violating his bail conditions. But more importantly, I can’t see the difference in 'risk to the public' between the two types of media.....

"Justice of the Peace Logue took only a 10-minute break before deciding in favour of the Crown, demonstrating she has apparently bought the government’s pandemic narrative hook, line and sinker. Although she paid lip service to the Charter, she gave short shrift to Randy’s freedom of expression and freedom of assembly. Randy and his lawyer are contemplating whether or not to appeal.

"Meanwhile, there’s one other aspect of the bail hearing that struck me as grossly unfair.... When Randy was brought into the call at the end from his jail cell to be asked whether he accepted the conditions the judge had ordered, it was apparent that the police officer had just brought him to the phone for that purpose, and he hadn’t been allowed to listen to or watch the entire proceedings. Accused people can normally attend their bail hearings, which allows them to listen carefully to the allegations being made against them by the Crown, inform their lawyer of any important points he or she might need to know, and evaluate their own lawyer’s performance in the courtroom. Randy was denied the benefit of all of these."

Muzzling Randy Hillier

February 22, 2022 - "Ontario's legislature has unanimously passed a motion authorizing the Speaker to bar an independent member from eastern Ontario from participating in the chamber. A motion moved by Government House Leader Paul Calandra says the house expresses its disapproval of Randy Hillier's 'continued disreputable conduct.' It calls on him to apologize for what Calandra called racist and discriminatory statements about federal Transport Minister Omar Alghabra, and for social media posts that Calandra says were insinuating a call to violence. The motion says the Speaker is authorized to not recognize Hillier in the legislature until the member for Lanark-Frontenac-Kingston publishes written apologies and the Speaker is satisfied of their sincerity."

SELICK: The railroading of Randy Hillier | Western Standard - Karen Selick: 

March 8, 2022 - "This proceeding shows a blatant disregard for the principles of fundamental justice. Calandra presented no evidence in support of his allegations. He never even specified the words he alleged to be racist, discriminatory, or an incitement to violence. He gave no opportunity to the accused to refute them. Hillier was not in attendance that day and had been given no advance notice that his conduct would be the subject of any motion. Much to their discredit, no member of the House then present asked any questions, and no debate was held.

"Note that in order to be released from the penalties laid upon him in this charade, Hillier would first have to admit his guilt by writing letters of apology. Otherwise, he wouldn’t be allowed to make a peep in the House. What if the allegations made against him weren’t true in the first place? This vicious circle would demand he confess to something he hadn’t done in order to have even the opportunity to deny having done them....

"And was the vote really unanimous? Did all 124 members of the House of all political stripes really sit there and vote in favour of compelling forced expression, a clear breach of Hillier’s Charter right to freedom of speech? Definitely not. For starters, Ontario MPPs are taking turns being present in 'cohorts' due to 'social distancing' requirements. At most, only half could have been present.... 

"Furthermore, it turns out a quorum in the Ontario legislature consists of the speaker plus only 11 other members. Procedurally, if nobody speaks up to voice any objection to a motion, the speaker is entitled to say it passed 'unanimously.' Abstentions are not counted. It’s entirely possible the only people who passed this so-called unanimous motion might have been Calandra, the speaker, and 10 other MPPs who might well have been sleeping or doing crossword puzzles....

"To the best of my knowledge, only one MPP (Belinda Karahalios) has come forward to say she didn’t vote to ban Randy Hillier from the House. Her husband Jim Karahalios tweeted that Calandra had actually waited until she had left the House before bringing his motion.

"Why has nobody raised this in the moribund media? Why is the world left believing that Hillier is universally condemned by his colleagues when the truth may well be that many of them secretly admire him and wish they had as much backbone?... Calandra succeeded in silencing a dissenting voice without having to prove he ever did anything wrong. I e-mailed Calandra’s office to see if I could interview him for this article, but he did not respond.

"Full disclosure: I’ve known Randy Hillier for at least 20 years, since the days when he headed up the Ontario Landowners Association and invited me to speak at conferences about property rights. I consider him one of Canada’s few politicians with any integrity, and I’m very sorry he made the decision not to stand for re-election in Ontario this year. Sadly, the unjust treatment he received at the hands of the Ontario legislature demonstrates what anyone else who might dare to thwart the establishment can expect."

Randy Hillier not running for re-election

March 5, 2022 - "A high-profile MPP from Eastern Ontario is walking away from public life. Lanark-Frontenac-Kingston MPP Randy Hillier, who sits as an independent, is returning to the private sector. He made the announcement through his Facebook page on Friday.

"Hillier has effectively been barred from participating in the legislative chamber.... Some had publicly expressed concerns about incidents which included alleged violations of public health rules and most recently supporting the Ottawa truckers' demonstration.

"Hillier's Facebook page included a formal letter of intent (also posted here) and the following statement.

Partisan politics has always been a corrupting force in our government, I have had the opportunity to wade through that swamp and see how it all really works, especially over these last two years.
However, I have also seen the good and valuable that came from my 15 years in elected office, helping the people of my riding, standing up for individual liberties and responsibility. Enclosed is my statement announcing I will not be seeking re-election; however, I look forward to opening a new chapter and continuing my advocacy for freedom, justice & democracy."

November 8, 2021 - "Independent Member of Provincial Parliament for Lanark-Frontenac-Kingston Randy Hillier announced on the morning of Monday, Nov. 8, 2021 that he would be running for Premier of Ontario in the next provincial election with a newly-formed Ontario PPC party. He made the announcement at a rally against vaccine mandates in Toronto’s Nathan Phillips Square.

"'I’ve got a little bit of announcement … you may have seen some paperwork going around the audience today. We’re gonna fight this politically as well. The purple wave is coming to Ontario,' Hillier announced to the crowd. 'We want to fight for freedom, for justice, for democracy, for fairness,' he continued. 'We have to fight this everywhere. The New Blue Party of Ontario will be a 'true blue' party with 'blue values,' the couple said."

November 26, 2020 - "Anger over the COVID-19 lockdown in Toronto and Peel Region is prompting a protest in downtown Toronto on Thursday morning. The ‘No More Lockdown’ rally will take place outside Queen’s Park at 10 a.m. Independent Member for Lanark-Frontenac-Kingston, MPP Randy Hillier says on twitter he will be ‘testing the law’ and leading the rally on the lawn of the Ontario legislature. Hillier is imploring others to join his protest.

"The independent MPP also praised Adam Skelly, the owner of Adamson BBQ, for defying provincial lockdown orders and offering dine-in services at his Etobicoke location. 'Today I recognized Adam Skelly of Adamson BBQ for his courage & conviction. He tested the law & I encourage others to do the same'.... 

Skelly has vowed to open his Etobicoke restaurant for the third straight day on Thursday ... despite being forced to shut down following orders from the city on Tuesday [and] being hit with provincial and local charges after opening up the location for a second time on Wednesday."

November 26, 2020 - "Randy Hillier, a Kingston, Ont.,-area MPP, has been charged under the Reopening Ontario Act after organizing an anti-COVID-19 lockdown rally outside Queen’s Park Thursday morning.

"Supporters banged pots and carried placards ... on the front lawn of the legislature. This is the second rally organized by Hillier in as many months to claim that the pandemic restrictions and lockdowns are unlawful and are causing more harm than good....

"During Toronto’s lockdown, only 10 people are allowed to gather outside. Hillier’s gathering far exceeded that limit.

"Hillier said in a phone interview on Thursday that he is looking forward to his day in court, so that he can challenge the constitutionality of Ontario’s COVID-19 restrictions."

Ontario MPP petitions against new lockdown

Ontario is on the brink of imposing new lockdowns. Quebec has just embraced and imposed measures never seen before in Canada, refuelling the fear of apocalyptic COVID projections. We must now ... push back.

The evidence is mounting, the methods used to test for COVID are defective, producing 50% false positives. Businesses are stretched thin, and cannot withstand more closures. Despite the claims of medical procedures beginning to take place, I continue receiving emails and calls about many appointments cancelled or those in need turned away. Now our children and grandchildren are being targeted with mandatory masking when the evidence shows they are not at risk to the virus, further demising herd immunity.

Our rights must be upheld and our freedoms respected; just like the State of Emergency overstepped its power, so will another lockdown.

A Petition to the Legislative Assembly of Ontario – No More Lockdowns

WHEREAS the threat of COVID-19 is now understood not to be a risk to the vast majority of the people of Ontario;

AND WHEREAS present testing methods are defective and inaccurate at discerning viral spread due to their excessive false-positive rate;

AND WHEREAS countless small and medium-sized businesses have already been lost as a result of the prior lockdown;

AND WHEREAS millions of people have been denied proper medical attention and needed procedures;

AND WHEREAS global data now demonstrates that children are at extremely low risk of serious illness, but are disproportionately harmed by lockdowns;

AND WHEREAS a growing number of physicians throughout Ontario and the world have recognized that COVID-19 is “not a killer virus, but a treatable condition”

Randy Hillier expelled from Ontario PC caucus

Ousted MPP accuses PC party operatives of 'egregious acts' | CBC News:

March 18, 2019 - "Ousted MPP Randy Hillier has again taken aim at the Ontario premier's office, this time from outside the Progressive Conservative caucus. Hillier, who has represented the eastern Ontario riding of Lanark–Frontenac–Kingston since 2007, was expelled from the PC caucus on Friday.

"He was initially suspended over comments he allegedly made to parents of children with autism during question period at Queen's Park last month, but Hillier told constituents in a letter last Thursday that the real reason for the rift was his refusal to stand and clap in the legislature....

"In another letter to constituents on Monday, Hillier claims two of the premier's key advisers have been engaged in an 'underhanded and relentless campaign' to boot him from caucus since last August..... Hillier now claims he was expelled [for] his 'refusal to breach oath of office,' his 'refusal to accept the obstruction and prevention of caucus criticism or input on public policy,' and 'for raising concerns of possible illegal and unregistered lobbying by close friends and advisors employed by Premier Ford'....

"He also claims he was expelled because he refused to seek party permission before speaking with the media, and complained he was 'condemned' for attending his brother's funeral without seeking permission.

"'Like many people, I had high hopes and expectations with the election of a PC government after 15 years of Liberal mismanagement, scandals, and harmful policies,' he wrote. 'I could not stand by and tolerate operatives engaging in similar and more egregious acts'....

"The premier's director of media operations said in a statement Monday that the allegations in Hillier's latest letter are 'absurd and categorically false.' Simon Jefferies ... said Hillier rarely showed up for caucus meetings, where members were asked for their input on party policy.... Jefferies said PC MPPs are encouraged to talk to the media, and have the right to 'proper bereavement'."

Feb. 24, 2011 - "On February 24, federal MP Scott Reid and Ontario MPP Randy Hillier held a joint press conference to promote the protection of a basic human right: the right to property. The two politicians will be introducing resolutions in their respective legislatures which would entrench constitutional protection to property rights in Ontario – and hopefully spark a move to enact similar protection in the rest of Canada as well....

"They propose to use section 43 of the Charter, which allows for an amendment affecting only one or more provinces (but not all) to be made by the Governor General, following the adoption of resolutions passed by the legislatures of the affected jurisdictions and both Houses of the federal Parliament.

"While the results of their efforts would apply only in Ontario, there is no doubt that they could encourage the citizens of other provinces to demand that their governments do the same – and pave the way for the national protection of these rights."
